Terms & Conditions

These terms and conditions apply to all referrals to the BUDGET Van Dealer Quote Line from 1st January 2005 to the exclusion of all other terms and conditions. All Van Dealers will be deemed to have accepted these terms and conditions by referring any business to the Quote Line.

1. Duties of the Van Dealers

1.1 Van Dealers agree to promote the services offered by BUDGET in connection with the sale, arrangement and administration of Van Insurance by displaying and distributing advertising materials and business cards provided by BUDGET and by referring clients to the BUDGET Van Dealer Quote Line.

1.2 Van Dealers are not authorised to offer any advice on behalf of BUDGET in connection with any insurance beyond recommending BUDGET as an intermediary able to arrange Van Insurance.

1.3 Van Dealers are not authorised to arrange any insurance or to commit BUDGET in any other way and nothing in these terms and conditions shall result in the Van Dealer being construed as BUDGET's agent.

2. Payment

2.1 BUDGET will pay Van Dealers £40 for each Van Insurance Policy sold through, and as a result of, referrals made to the BUDGET Van Dealer Quote Line*.

Example: A Van Dealer selling 10 policies in a calendar month will receive:

10 x £40 = £400.00

2.2 Fees will only be paid provided that:

• Van Dealer Reference Numbers allocated by BUDGET are provided when the Quote Line is contacted
• Policies remain in force for at least 14 days
• BUDGET receives the full amount of the premium or (where payment is to be made in instalments) the first instalment of premium
• The policy is sold via the Van Dealer Quoteline and for the avoidance of doubt, fees will not be paid if the policy is sold by any other method.

2.3 No fees will be payable in respect of policy renewals.

2.4 After any month during which the conditions set out in paragraph 2.2 above were met in respect of any policies sold by BUDGET as a result of referrals by any Van Dealer, BUDGET will send that Van Dealer a statement showing the number of policies concerned together with the remittance for the fees due.

3. Policy Administration

BUDGET shall determine whether, and on what basis, it is able to provide a quotation for Van Insurance in response to any referral to the BUDGET Van Dealer Quote Line and will be solely responsible for the arrangement and administration of all Policies sold in accordance with its normal procedures.

4. Information and Materials

4.1 All information which may be made available to BUDGET in connection with any use of the BUDGET Van Dealer Quote Line shall be freely available for use by BUDGET as it thinks fit subject to the obligations of BUDGET and all Van Dealers to comply with the provisions of the Data Protection Act 1998.

4.2 All Van Dealers are required to treat as confidential all information relating to the clients, business partners, finances, operations, business activities or affairs of BUDGET other than information which is in or comes into the public domain or information made available by a third party free from obligations of confidentiality.

5. Advertising Materials

All advertising materials, business cards and other materials, which may be made available by BUDGET in connection with the operation of the BUDGET Van Dealer Quote Line and all rights therein shall be and remain the sole property of BUDGET. Nothing in these terms and conditions shall be construed as granting to either party any right to use any of the names, logos, trademarks, confidential information or intellectual property rights of the other party.

6. General

6.1 BUDGET may withdraw the BUDGET Van Dealer Quote Line or vary the fees payable or otherwise amend these terms and conditions at any time.

6.2 BUDGET's decision in relation to all disputes with any Van Dealer shall be final and binding on the parties.

6.3 These terms and conditions shall be governed by English Law and the parties agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
